On Feb 7th, 2022, the golf industry released our comments to the EPA and ACE reflecting the golf industry's opposition to their proposed WOTUS Rule. While the initial intent of the Rule was to rescind the 2020 WOTUS Rule and inform the public that they would be issuing a new Rule the public would have an opportunity to comment. While this Rule does rescind the 2020 Rule, it also proposes new regulatory guidance very similar to the 2015 WOTUS Rule, which the US Supreme Court ruled it was exceeded the Administration's authority and struck down its implementation.
